....But Rove's attorney informed the committee in a letter last week
that Rove will decline to appear because he is subject to the executive
privilege claimed by The White House.
At best it is a dubious claim. A federal lawsuit is pending on the issue.
If the Judiciary Committee fails to follow through and charge Rove with
contempt, however, it will weaken the case against Bush's dangerous
and unprecedented broadening of the executive privilege rule.
In 1974, lawyers for then-President Richard Nixon claimed Nixon had
an absolute right of executive privilege.
....The Supreme Court conceded such a privilege but said it is not
absolute if a judge concludes that there is a compelling governmental
interest in disclosing the conversations.
